Terms of Service

Effective Date: January 21, 2026

These Terms of Service ("Terms") govern access to and use of NeighborShare.net ("NeighborShare," "we," "us," or "our"), an online marketplace platform operated by NeighborShare LLC. By creating an account, listing equipment, or using the platform in any manner, you ("User," "you") agree to be legally bound by these Terms.

If you do not agree, do not use the platform.

1 Platform Role & Nature of Services

NeighborShare is a neutral online marketplace that enables users to list tools and equipment for rent to other users. NeighborShare does not own, store, inspect, maintain, deliver, operate, insure, or control any equipment listed on the platform. NeighborShare is not a party to any rental transaction, agreement, or dispute between users.

NeighborShare provides platform access only.

2 Eligibility & Account Requirements

  • Users must be 18 years of age or older
  • Users must provide accurate and truthful information
  • You are responsible for all activity under your account
  • NeighborShare may suspend or terminate accounts at its discretion

3 Listings & Equipment Responsibility

All equipment listed on NeighborShare:

  • Is owned solely by the listing user
  • Is listed at the user's sole discretion and responsibility
  • May include power tools and heavy equipment

Listing users are solely responsible for:

  • Equipment condition, safety, maintenance, legality, and operation
  • Accurate descriptions and disclosures
  • Determining appropriate renters
  • Establishing rental terms, deposits, and requirements

NeighborShare does not verify, inspect, or certify any equipment.

4 Prohibited Items & Listings

The following items are strictly prohibited from being listed on NeighborShare. Violations may result in immediate account termination and potential legal action:

Weapons & Firearms

  • • Guns, rifles, shotguns, or ammunition
  • • Knives designed as weapons
  • • Crossbows, tasers, or stun guns
  • • Any weapon or weapon accessories

Hazardous Materials

  • • Explosives or fireworks
  • • Toxic or poisonous chemicals
  • • Radioactive materials
  • • Flammable gases or liquids (except standard fuel tanks)

Illegal & Stolen Items

  • • Stolen property of any kind
  • • Drug paraphernalia
  • • Counterfeit goods
  • • Items illegal under federal, state, or local law

Licensed Equipment

  • • Medical devices requiring certification
  • • Commercial aircraft or drones requiring FAA license
  • • Equipment requiring special permits to operate
  • • Heavy machinery requiring CDL or special licensing

Unsafe Items

  • • Recalled products
  • • Equipment with known safety defects
  • • Non-functioning or dangerously damaged tools
  • • Items with exposed wiring or broken safety guards

Other Prohibited Items

  • • Adult or explicit content/items
  • • Surveillance equipment for illegal use
  • • Lock-picking tools or burglary equipment
  • • Any item intended to harm others

Users who list prohibited items will have their accounts immediately suspended and may be reported to law enforcement authorities.

5 Assumption of Risk (Critical)

Users acknowledge that renting, lending, and using tools and equipment—especially power tools—involves inherent risks, including bodily injury, property damage, death, or financial loss.

ALL USE OF EQUIPMENT IS AT THE USER'S OWN RISK.

To the fullest extent permitted by law, users voluntarily assume all risks associated with renting, listing, handling, transporting, and using equipment obtained through NeighborShare.

6 No Liability for Injuries or Damages

NeighborShare shall not be liable for any injuries, accidents, damages, losses, theft, destruction, or claims arising from or related to:

Use or misuse of equipment
Equipment malfunction or failure
User conduct
Rental disputes
Power tool usage
Third-party actions

This limitation applies regardless of theory of liability.

7 Payments & Fees

NeighborShare charges platform access fees (monthly, annual, per-listing, or other options as selected by the user).

  • NeighborShare does not collect rental payments
  • All rental payments are made directly between users
  • NeighborShare is not responsible for nonpayment, refunds, chargebacks, deposits, or disputes
  • Platform fees are non-refundable, unless required by law

8 No Insurance Provided

NeighborShare does not provide insurance coverage of any kind, including:

Liability

Equipment Damage

Injury

Theft

Property Loss

Users are solely responsible for obtaining any insurance they deem necessary.

9 User Conduct & Compliance

Users agree to:

  • Use the platform lawfully
  • Comply with all local, state, and federal laws
  • Use equipment only as intended
  • Follow all safety guidelines and manufacturer instructions
  • Not list illegal, unsafe, or prohibited items

10 Release & Waiver of Liability

To the maximum extent permitted by law, users release, waive, and discharge NeighborShare LLC, its members, managers, officers, employees, and agents from any and all claims, demands, damages, liabilities, or causes of action arising from or related to use of the platform, equipment rentals, injuries, payments, or disputes.

11 Indemnification

Users agree to indemnify, defend, and hold harmless NeighborShare from any claims, damages, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

  • Their listings
  • Their equipment
  • Their rental activities
  • Their use of power tools
  • Any injury or damage involving their transactions

12 No Warranties

NeighborShare is provided "as is" and "as available," without warranties of any kind, express or implied.

13 Termination

NeighborShare may suspend or terminate access at any time, with or without notice, for any reason.

14 Governing Law & Venue

These Terms shall be governed by the laws of the State of Alabama, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in the state or federal courts located in Madison County, Alabama, even if the user is located elsewhere.

15 Modifications

NeighborShare may update these Terms at any time. Continued use constitutes acceptance.
